Parkeroo Terms of Service

Welcome to Parkeroo. These Terms of Service ("Terms") govern your use of the Parkeroo website and app (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Parkeroo is

Parkeroo is a marketplace that connects people who have private driveways or parking spaces ("Hosts") with people who want to park ("Drivers"). Parkeroo is not a party to the parking arrangement itself. We do not own, control, inspect, or manage any parking space listed on the Service.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Service. By using the Service you confirm that you meet these requirements.

3. Host responsibilities

If you list a space, you confirm that: (a) you own the space or otherwise have the legal right to rent it out, including under any lease, homeowners association rules, or local laws that apply to you; (b) the space is safe and usable for ordinary passenger vehicle parking; and (c) your listing information, including price and description, is accurate. You are responsible for any taxes that apply to income you earn through the Service.

4. Driver responsibilities

If you park through the Service, you agree to: (a) park only in the space you booked, for the time you booked; (b) follow any reasonable instructions in the listing; (c) leave the space in the condition you found it; and (d) move your vehicle when your session ends. You are responsible for your vehicle and its contents.

5. Parking is at your own risk

To the maximum extent allowed by law, parking arranged through the Service is at the vehicle owner's risk. Parkeroo does not provide insurance for vehicles, property, or persons. Hosts and Drivers are responsible for maintaining their own insurance. Parkeroo is not liable for theft, damage, personal injury, towing, citations, or disputes between Hosts and Drivers, except where liability cannot be excluded by law.

6. Payments and fees

Payments are processed by Stripe. Drivers are charged based on the listing price and time parked, with a 15-minute minimum. Parkeroo deducts a platform fee of 20% of each transaction; the remainder is paid to the Host through Stripe. Hosts must complete Stripe's onboarding, including identity verification, before receiving payouts. Stripe's own terms apply to payment processing.

7. Cancellations and refunds

Charges are based on actual parking time recorded by the Service. If you believe you were charged in error, contact us within 7 days and we will review the session in good faith. Refunds are issued at our reasonable discretion, and where required by law.

8. Acceptable use

You agree not to misuse the Service, including by: creating listings for spaces you have no right to rent; using the Service for any unlawful purpose; harassing other users; attempting to bypass fees; or interfering with the operation of the Service. We may suspend or remove accounts and listings that violate these Terms.

9. Content and ratings

You are responsible for content you post, including listing descriptions and ratings. Ratings must reflect your genuine experience. We may remove content that is unlawful, deceptive, or abusive.

10. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or create risk for other users, with or without notice. Sections that by their nature should survive termination (including sections 5, 11, and 12) survive.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and availability. We do not guarantee that any space will be available, accurately described, or suitable for your vehicle.

12. Limitation of liability

To the maximum extent allowed by law, Parkeroo's total liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid to Parkeroo in the 3 months before the claim, or (b) 100 US dollars. Parkeroo is not liable for indirect, incidental, special, or consequential damages.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new date. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law rules, and disputes will be resolved in the courts located there, unless the law where you live gives you mandatory rights to something different.
